Mich Supreme Court: Homeless sex offenders must still list a “home” or be fined/jailed

by

It’s bad enough that Michigan is run entirely by Republicans at the moment. But now we learn that our GOP-led Supreme Court has completely lost its mind. Yesterday, they ruled that homelessness is no excuse for sex offenders not registering their home with the local officials.

A Michigan Supreme Court says homeless sex offenders must report their home address to the state even though they don’t actually have homes. Paroled sex offenders are legally required to provide their home address to the state sex offender registry. But what if they’re homeless?

[T]he Michigan Supreme Court says homelessness is no excuse. In a 4 to 3 decision, the high court ruled the lower courts had not taken the ‘intent’ of the law into account, adding homelessness doesn’t prevent sex offenders from complying with the law requiring them to report their ‘home’ address to the state.

The dissenting justices describe the majority’s opinion as defying ‘common sense.’

Defies common sense? It defies REALITY. The case came about because a homeless man on the sex offender list listed a non-profit where he was receiving help as his home address. He registered but that was the only address he had to give. I’m guessing “under the I-23 overpass south of Ann Arbor” or some such wasn’t going to fly with officials so he used the best thing he had.

He was then arrested.

After this week’s ruling he is now subject to a fine or jail or both based on the law.

Is it too much to ask that our Supreme Court justices are sane? That they make rulings that are rational and obeyable???

Aye, aye, aye…
